We reserve the right to modify these Terms of Service at any time by posting revised terms on our website. We will provide you with 30 days’ notice of any material changes. Your continued use of our Services after the effective date of revised terms constitutes your acceptance of the changes.

2. Service Description

2.1 Overview

Footprint Gone provides data removal services designed to help individuals remove their personal information from data brokers, people-search websites, search engines, and other third-party websites that publicly list or sell personal data.

2.2 Service Scope

Our Services include:

  • Scanning third-party websites and databases to locate your personal information
  • Identifying data brokers and third-party sites that contain your personal data
  • Submitting opt-out and removal requests to identified sites on your behalf
  • Verifying removals by conducting follow-up scans
  • Providing reports detailing scan results and removal status
  • Offering customer support regarding removal requests

2.3 Service Limitations

You acknowledge and understand the following limitations of our Services:

  • No Guarantee of Complete Removal: While we will use reasonable efforts to submit removal requests, we cannot guarantee that all personal information will be removed from all websites or databases. Some websites may decline removal requests, require additional verification, or re-list information after removal.
  • Timeline Variability: The time required for third-party sites to process and complete removal requests varies significantly. Some sites may remove information within days; others may take weeks or months. Some may not remove information at all.
  • New Data Listings: Data brokers frequently re-aggregate and re-list personal information from public records and other sources. Even after successful removal, your information may reappear on third-party sites, requiring additional removal requests.
  • Limited Scope: Our Services primarily target commercial data brokers and people-search websites. We do not remove information from government databases, court records, public registries, or private websites (e.g., social media platforms) unless they offer opt-out mechanisms for data brokers.
  • Information Sources: We rely on third-party data brokers’ representations about removal completion. We cannot independently verify that all personal information has been removed from their databases, particularly regarding information retained for legal compliance or archived purposes.
  • Recurring Scans: Ongoing removal may require multiple scan and removal cycles. We will conduct follow-up scans as included in your service plan, but complete removal may require additional services or extended monitoring.

3. Eligibility and Account Registration

3.1 Eligibility Requirements

To use our Services, you must:

  • Be at least 18 years of age (or the age of legal majority in your jurisdiction)
  • Have the legal capacity to enter into a binding agreement
  • Provide accurate, complete, and current information
  • Have the authority to request removal of the personal data you submit (see Section 9 regarding authorization)

If you are using our Services on behalf of someone else (e.g., a spouse, parent, or dependent), you must have that person’s explicit written authorization.

3.2 Account Registration

To access certain features of our Services, you must create an account by providing:

  • Your full name
  • A valid email address
  • Your phone number
  • Your residential address
  • A secure password of your choosing

You agree to:

  • Provide accurate and complete information
  • Update your information to keep it current and accurate
  • Maintain the confidentiality of your password and account credentials

  • Not share your account credentials with third parties

3.3 Account Verification

We may require identity verification before processing removal requests. You agree to provide documents such as government-issued identification, utility bills, or other proof of identity as reasonably requested.

4. Pricing and Payment Terms

4.1 Currency and Pricing

All prices are displayed in British Pounds (GBP) and are inclusive of Value Added Tax (VAT) at the applicable rate unless otherwise stated.

4.2 Payment Methods

We accept payment via:

  • Credit and debit cards (Visa, Mastercard, American Express) processed through Stripe
  • PayPal
  • Other payment methods as may be offered from time to time

4.3 Payment Processing

By providing payment information, you authorize us to charge your payment method for Services purchased. You represent and warrant that:

  • You are the authorized user of the payment method
  • You have sufficient funds or credit available
  • You will not dispute the charge (except in cases of fraud or unauthorized use)

All payment information is processed securely and encrypted. We do not store your full credit card details; these are processed exclusively by our payment processors (Stripe and PayPal), which comply with the Payment Card Industry Data Security Standard (PCI DSS).

4.4 Billing and Charges

You authorize us to charge your payment method for:

  • One-time service purchases (single removals, scans, bundles)
  • Recurring subscription fees (if you enroll in a subscription plan), charged on the agreed-upon schedule (monthly, quarterly, or annually)
  • Any additional services you purchase

Charges will appear on your statement as “Footprint Gone” or a related descriptor.

4.5 Failed Payments

If your payment fails, we will attempt to process the charge again. If subsequent attempts fail, we may suspend your account and remove access to Services until payment is received or you update your payment information.

4.6 Price Changes

We reserve the right to change our prices at any time. For existing subscriptions, price increases will take effect at your next renewal date, unless required to be communicated sooner. For one-time purchases, the price charged will be the price in effect at the time of purchase.

5. Refund Policy

5.1 Consumer Rights and Cooling-Off Period

Under UK law, specifically the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013, you have the right to cancel your purchase and receive a refund within 14 days of purchase (the “Cooling-Off Period”), provided that removal requests have not been submitted on your behalf.

5.2 Refund Eligibility

You are eligible for a full refund if:

  • You request cancellation within 14 days of purchase
  • No removal requests have been submitted to third-party sites on your behalf
  • You have not accessed or used the service beyond a reasonable test of the service

5.3 Non-Refundable Services

You are not eligible for a refund if:

  • Removal requests have already been submitted to third-party sites (the digital service has been fully performed)
  • You have exceeded the 14-day Cooling-Off Period
  • You have used more than a minimal portion of your purchased credits
  • You purchased a subscription and are requesting a refund after the initial 30-day period

5.4 Subscription Refunds

If you cancel a subscription within the first 30 days of purchase and no removal requests have been submitted, you are entitled to a full refund. If you cancel after 30 days, you will not receive a refund for the current billing period, but your subscription will be cancelled, and you will not be charged for future periods.

5.5 Bundle and Credit Refunds

Bundles and credit packages are non-refundable once purchased. However, if you have not used all of your credits, you may receive a prorated refund based on the number of unused credits, calculated at the rate of a single removal less transaction fees.

5.6 How to Request a Refund

To request a refund within the Cooling-Off Period, you must contact us at refunds@footprintgone.com with:

  • Your account email address
  • Your order number
  • The date of purchase
  • The reason for the refund request

5.7 Refund Processing

Upon approval of your refund request, we will process the refund to your original payment method within 5-10 business days. Bank transfers and card refunds may take an additional 2-5 business days to appear in your account, depending on your financial institution.

5.8 Refund Exceptions

We reserve the right to deny refund requests that appear to be abusive, including:

  • Multiple refund requests from the same account within a short period
  • Requests that clearly indicate you have benefited from the Services
  • Fraudulent or unauthorized requests

6. Subscription Terms and Cancellation

6.1 Subscription Services

We offer subscription plans that provide ongoing removal services, regular scans, and continuous monitoring. Subscriptions renew automatically unless cancelled.

6.2 Auto-Renewal

Your subscription will automatically renew at the end of each billing period (monthly, quarterly, or annually, as selected) unless you cancel. You will be charged the subscription fee on the renewal date. You acknowledge that you are authorizing recurring charges.

6.3 Cancellation

You may cancel your subscription at any time by:

  • Logging into your account and accessing subscription settings
  • Emailing us at legal@footprintgone.com with your cancellation request
  • Contacting our customer support team

Cancellation will take effect at the end of your current billing period. You will not receive a refund for the current billing period, but you will not be charged for future periods.

6.4 Suspension for Non-Payment

If a subscription renewal payment fails and is not resolved, we may suspend your account and prevent access to Services until payment is received.

7. Credits and Bundles

7.1 Service Credits

Many of our service packages are sold as “credits” or “removal packages.” One credit typically equals one personal information removal from one third-party site.

7.2 Credit Expiration

Credits expire 12 months from the date of purchase. Unused credits will be forfeited after the expiration date and cannot be refunded or transferred to another account.

7.3 Bundle Purchases

Bundles are sold as packages of multiple credits at a discounted rate. Bundle credits are subject to the same 12-month expiration period. Bundles are non-transferable and can only be used by the account holder.

7.4 Credit Usage

Credits are consumed when you submit a removal request. We will deduct one credit when we submit a removal request to a third-party site on your behalf. If a removal request fails or is not submitted, the credit may be credited back to your account at our discretion.

8. User Responsibilities and Conduct

8.1 Accurate Information

You agree to provide accurate, complete, and current information in all removal requests. You understand that providing false or misleading information may result in removal requests being rejected and may violate applicable laws.

8.2 Authorization

You represent and warrant that you are authorized to request removal of the personal information you provide. You may only request removal of:

  • Your own personal information, or
  • Personal information of individuals for whom you have explicit written authorization

You are prohibited from requesting removal of someone else’s personal information without authorization.

8.3 Legal Compliance

You agree to use our Services only for lawful purposes and in compliance with all applicable laws and regulations. You specifically agree not to use our Services to:

  • Harass, threaten, or defame any individual
  • Interfere with someone else’s legal rights
  • Conceal identity for fraudulent purposes
  • Violate any applicable data protection, privacy, or consumer protection laws
  • Commit identity theft or fraud

9. Power of Attorney and Authorization Agreement

9.1 Authorization

By using our Services to submit removal requests, you grant Footprint Gone and its authorized agents a power of attorney to:

  • Contact data brokers, people-search websites, and other third-party sites on your behalf
  • Submit written and electronic removal requests using your personal information
  • Create accounts on third-party websites if necessary to submit removal requests
  • Provide your personal information to third-party sites for the purpose of verifying your identity and facilitating removal
  • Receive responses from third-party sites regarding removal status
  • Take any actions reasonably necessary to effect the removal of your personal information

9.2 Scope of Authority

This authorization is limited to:

  • The specific personal information you authorize for removal
  • The purpose of removing that information from third-party sites
  • Contact with third-party sites for the purpose of submitting removal requests and verifying removal

This authorization does not grant us authority to:

  • Access, control, or modify your accounts on third-party sites
  • Use your information for any purpose other than removal
  • Sell your information or share it with third parties except as necessary for removal

9.3 Duration

This authorization remains in effect for as long as your account is active and continues until you explicitly revoke it in writing. You may revoke this authorization at any time by emailing legal@footprintgone.com, but revocation will not affect actions already taken on your behalf.

9.4 Representation

By agreeing to this authorization, you represent and warrant that:

  • You are the person whose data will be removed, or you have legal authority to act on behalf of that person
  • The personal information you provide is accurate and complete
  • You understand that third-party sites may independently verify your identity before processing removal requests
  • You consent to Footprint Gone processing your personal information as described in our Privacy Policy

10. Intellectual Property Rights

10.1 Company Property

All content, materials, designs, features, functionality, and code on our website and Services are the exclusive property of Footprint Gone or our licensors and are protected by UK and international copyright, trademark, trade secret, and other intellectual property laws.

10.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our Services for your personal, non-commercial purposes. You agree not to:

  • Reproduce, copy, modify, or create derivative works based on our Services or content
  • Reverse engineer, decompile, or disassemble our Services or code
  • Remove, alter, or obscure any copyright notices, watermarks, or proprietary markings

  • Resell, rent, lease, or lend our Services

You retain all rights to any content you submit to us (communications, removal requests, etc.). By submitting this content, you grant us the limited right to use, process, and store it solely for the purpose of providing our Services and as otherwise described in our Privacy Policy.

11. Limitation of Liability

11.1 Disclaimer of Warranties

Our Services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Warranties that our Services will be uninterrupted, error-free, secure, or free from viruses or malware
  • Warranties that removal requests will be successful or timely
  • Warranties that your personal information will be completely removed from all third-party sites

11.2 Limitation of Damages

To the fullest extent permitted by law, Footprint Gone shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses arising out of or related to:

  • Your use of or inability to use our Services
  • Unauthorized access to or alteration of your personal information
  • Third-party removal decisions or actions
  • Any conduct or content of third parties
  • Any other matter relating to our Services

11.3 Cap on Liability

Except for claims arising from your breach of Section 9 (Authorization) or claims that cannot be limited by law, our total liability to you for any claims arising out of or relating to these Terms or our Services shall not exceed the amount you have paid to Footprint Gone in the 12 months preceding the claim.

11.4 Essential Terms

You acknowledge that these limitations of liability are essential terms of this Agreement, and that we would not provide our Services without these limitations.

12. Indemnification

You agree to indemnify, defend, and hold harmless Footprint Gone and its officers, directors, employees, agents, and successors from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or relating to:

  • Your use of our Services
  • Your violation of these Terms of Service
  • Your violation of any applicable law or regulation
  • Any content you submit to us
  • Claims by third parties that your removal request violates their rights
  • Your breach of the authorization agreement in Section 9

13. Third-Party Services and Links

13.1 Third-Party Websites

Our Services involve interaction with third-party websites, data brokers, and service providers. We are not responsible for the:

  • Content, accuracy, or completeness of information on third-party sites
  • Practices, policies, or conduct of third-party sites
  • Removal decisions made by third-party sites
  • Re-listing of your information by third parties

13.2 External Links

Our website may contain links to third-party websites. We do not endorse these websites and are not responsible for their content, policies, or practices. Your use of third-party websites is at your own risk and subject to their terms of service and privacy policies.

14. Governing Law and Jurisdiction

14.1 Governing Law

These Terms of Service and all matters arising out of or relating to our Services shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles.

14.2 Jurisdiction and Venue

Both parties irrevocably submit to the exclusive jurisdiction of the courts located in England and Wales for resolution of any dispute arising out of these Terms or our Services. You agree that any legal action or proceeding shall be brought exclusively in the courts of England and Wales, and you consent to the personal jurisdiction of these courts.

15. Dispute Resolution and Complaints Procedure

15.1 Informal Resolution

15.2 Formal Complaints Procedure

If informal resolution is unsuccessful, you may initiate our formal complaints procedure as outlined in our Complaints Procedure document. We will acknowledge your complaint within 2 business days and work to resolve it within 14 business days.

15.3 Alternative Dispute Resolution

If you remain dissatisfied after our complaints procedure, you may pursue alternative dispute resolution (ADR) through a qualified ADR provider before pursuing legal action.

15.4 Legal Action

You retain the right to pursue legal action in the courts of England and Wales if dispute resolution is unsuccessful, subject to the governing law and jurisdiction provisions in Section 14.

16. Termination

16.1 Termination by You

You may terminate your account at any time by emailing legal@footprintgone.com. Upon termination, your access to our Services will be revoked, but you will remain responsible for any outstanding charges.

16.2 Termination by Us

We may terminate your account and access to our Services immediately, without notice, if:

  • You violate these Terms of Service or any applicable law
  • You engage in fraudulent activity or misuse of our Services
  • You submit false or misleading information
  • You request removal of someone else’s information without authorization
  • You attempt to circumvent our security measures or manipulate our Services
  • You use automated means (bots, scrapers) to access our Services without permission
  • You provide payment information that is fraudulent or unauthorized

16.3 Survival

Upon termination, the following sections survive: 10 (Intellectual Property), 11 (Limitation of Liability), 12 (Indemnification), 14 (Governing Law), and 15 (Dispute Resolution).

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if not possible, shall be severed. The remaining provisions shall continue in full force and effect.

18. Entire Agreement
